There has been a bit of buzz recently surrounding the 3DS it has become apparent that Nintendo is targeting consoles that utilize homebrew and CFW. It appears to be a permanent ban and the exact method of detection has not been made public yet.

Perhaps the safest route if you are not already banned is to disconnect from the internet till new information is brought forth.

Source ( I've seen this a few places now, but GBATemp will probably have the most reports. ) https://gbatemp.net/threads/regarding-the-recent-3ds-banwave.471781/

Update: Same link as above. The theory is custom CIAs being run show up as a bogus title. That in conjunction with having the options to show your friends what game you are playing as well as SpotPass being switched on are ways they think Nintendo is spotting modified consoles. Also homebrew titles and CFWs are thought to be big red flags.

This GBATemp member phalk made a nice tutorial for using something he calls '3DS Incognito Mode'

What does this do?

We will rename the PTM savegame so the system creates a new one without the previous information of your used titles.

This way, any CIA Homebrew run during this window of time will be logged in this temporary PTM save and won't affect your previous PTM save.

It's a little bit of work though.
